Divorce Process And Typical Timeline
A typical New Jersey divorce proceeds through several steps, which must be completed before the court can issue a final judgment:
- Filing the complaint: One spouse files a divorce complaint with the court, identifying the reason for divorce and requesting relief such as custody or support.
- Service of process: The other spouse must be formally served and given 35 days to file an answer or appearance.
- Case management and court oversight: The court issues a Case Management Order setting deadlines for completing discovery and attending required conferences.
- Financial disclosures and discovery: Both spouses exchange Case Information Statements detailing income, assets, debts and expenses.
- Settlement efforts and mandatory programs: Many cases involve Early Settlement Panels or mediation sessions where neutral professionals provide guidance on resolving issues.
- Motion practice and hearings: If disputes arise over temporary support, custody or access to information, the court may hold hearings and issue interim orders.
- Preparation and trial: Contested cases proceed to trial when settlement efforts fail, where the judge hears testimony, reviews evidence and issues a final decision.
Once all issues are resolved, the court enters a Final Judgment of Divorce, legally ending the marriage and setting the terms for custody, support and property division. The timeline depends on the level of cooperation between spouses, the complexity of financial issues and whether disputes require judicial involvement.
Understanding New Jersey Divorce Grounds
New Jersey permits no-fault and fault-based divorces. Although most spouses rely on no-fault grounds, fault-based options are available in specific circumstances.
No-fault divorce is most commonly based on irreconcilable differences. This requires showing that the marital relationship has broken down for at least six consecutive months and that reconciliation is not reasonably possible. The state also recognizes an 18‑month separation ground when spouses have lived apart continuously for that period.
Fault-based divorce grounds still exist under state law, including adultery, desertion and extreme cruelty. This type of divorce may be appropriate when a spouse needs to establish a specific timeline or address conduct that affected the marriage.
Uncontested Divorce Versus Contested Divorce In New Jersey
An uncontested divorce occurs when both spouses agree on all major issues such as child custody, parenting time, support and property division. Uncontested cases move efficiently because the court primarily reviews the settlement for compliance with New Jersey law.
A contested divorce arises when spouses disagree on one or more issues and require court intervention to resolve them. Contested divorces may involve extensive discovery, expert evaluations and multiple court appearances, which can prolong the overall duration.
